These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and CNCTASPHR (“CNCTASPHR,” “Company,” “we,” “us,” or “our”) governing your access to and use of https://www.cnctasphr.com and all related features, applications, content, and services (collectively, the “Platform”).

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Eligibility and Age Requirement

The Platform is strictly limited to individuals twenty-one (21) years of age or older.

By creating an account or accessing the Platform, you represent and warrant that:

• All information provided is truthful and accurate.

If CNCTASPHR determines that a user is under 21:

• The account will be permanently terminated;
• All associated data will be deleted from active systems;
• Repeated attempts to circumvent age restrictions may be reported to appropriate authorities.

2. Nature of the Platform

CNCTASPHR is a user-driven social community platform that enables:

• User profile creation
• Text posts
• Image uploads
• Video uploads
• Embedded YouTube content
• Direct user messaging
• Community-based advertising by verified platform members

CNCTASPHR does not pre-screen user content but reserves the right to monitor, remove, or restrict content at its sole discretion.

The Platform is not intended for unlawful use or distribution in jurisdictions where access would violate applicable law.

3. Intellectual Property Rights

Company Property

All source code, software, databases, design elements, graphics, logos, trademarks, service marks, text, and functionality are owned by CNCTASPHR or its licensors.

Users are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal, lawful use only.

No part of the Platform may be copied, reproduced, reverse-engineered, distributed, sold, or exploited without prior written consent.

4. User-Generated Content

Users may post, upload, transmit, or share content (“User Content”).

You retain ownership of your User Content.

By posting content, you grant CNCTASPHR a worldwide, non-exclusive, royalty-free license to:

• Host
• Store
• Display
• Reproduce
• Distribute
• Adapt (for formatting purposes only)

solely for purposes of operating and improving the Platform.

You represent and warrant that:

• You own or have rights to all posted content;
• Your content does not infringe third-party rights;
• Your content does not violate applicable law;
• Your content is not defamatory, obscene, fraudulent, or unlawful.

CNCTASPHR assumes no liability for User Content.

Copyright complaints are handled pursuant to our DMCA Policy.

5. Prohibited Conduct

You agree not to:

• Access the Platform through automated means (bots, scraping tools, crawlers);
• Reverse engineer or interfere with Platform security;
• Upload malicious code or disrupt services;
• Harass, threaten, or harm other users;
• Impersonate any person or entity;
• Use the Platform for illegal purposes;
• Create accounts using false identity;
• Circumvent account termination.

Violation may result in suspension, termination, and legal action.

6. Community Advertising

Businesses and users may promote products or services within the Platform only if they maintain an active member account.

CNCTASPHR does not provide behavioral advertising or cross-site targeted advertising.

All internal promotional content must comply with these Terms.

CNCTASPHR is not responsible for transactions between users.

7. Account Termination

CNCTASPHR reserves the right to:

• Suspend or terminate accounts without notice;
• Remove User Content;
• Deny access for violation of these Terms;
• Prevent re-registration following termination.

Termination does not waive rights or remedies available under law.

8. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CNCTASPHR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT

CNCTASPHR does not guarantee uninterrupted access, error-free functionality, or security from unauthorized intrusion.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CNCTASPHR SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES;
• LOSS OF DATA;
• LOSS OF PROFITS;
• BUSINESS INTERRUPTION.

TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• The amount paid by you to CNCTASPHR in the preceding twelve (12) months; or
• $100 USD.

Some jurisdictions do not allow certain limitations; those limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless CNCTASPHR and its affiliates from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of the Platform;
• Your violation of these Terms;
• Your User Content;
• Your violation of third-party rights.

11. Privacy

Use of the Platform is governed by:

• The Privacy Policy
• The Cookie Policy

These policies are incorporated by reference.

12. Dispute Resolution

Informal Resolution

Parties agree to attempt good-faith negotiation for at least 30 days before initiating arbitration.

Binding Arbitration

Except where prohibited by law:

• Disputes shall be resolved by binding arbitration;
• No class actions or representative proceedings;
• Arbitration limited to individual claims.

Claims relating to intellectual property, unauthorized access, or injunctive relief may be brought in court.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Exclusive jurisdiction lies in state or federal courts located in Texas.

14. Electronic Agreement

By using the Platform, you consent to:

• Electronic records
• Electronic signatures

You waive rights requiring physical signatures or paper documentation.

15. Modifications

CNCTASPHR may modify these Terms at any time.
