DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY

CNCTASPHR respects the intellectual property rights of others and expects users of the Platform to do the same.

Because CNCTASPHR allows users to create, upload, publish, and share content, including text, images, videos, music, audio recordings, podcast clips, voice recordings, files, stories, profile content, group content, and other media, users must only upload or share content they own or have permission to use.

This DMCA Policy is adopted pursuant to the Digital Millennium Copyright Act, 17 U.S.C. §512, and establishes procedures for reporting alleged copyright infringement, responding to such claims, submitting counter-notifications, and addressing repeat infringement.

This Policy should be read together with CNCTASPHR’s Terms of Service, Privacy Policy, Cookie Policy, Community Standards, and Intellectual Property Policy.

1. Designated Copyright Agent

Pursuant to 17 U.S.C. §512(c)(2), CNCTASPHR has designated the following agent to receive notifications of claimed copyright infringement:

All notices must be submitted in writing and must contain the information required by Section 2 below.

To help CNCTASPHR review a notice efficiently, please identify the specific content at issue, such as the profile, post, story, image, video, audio file, music upload, podcast clip, voice recording, group content, file upload, or other material claimed to be infringing.

2. Notice of Claimed Infringement

If you believe that material available on the Platform infringes your copyright, you must submit a written notification containing the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;
  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are involved, a representative list of those works;
  • Identification of the material claimed to be infringing, including sufficient information to permit CNCTASPHR to locate the material, such as a URL, username, profile link, post link, story reference, group name, file name, audio title, video title, screenshot, or other identifying detail;
  • Your name, mailing address, telephone number, and email address;
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Failure to provide all required elements may delay review or render the notice ineffective.

Submitting false, incomplete, or misleading claims may result in rejection of the notice and may expose the sender to liability under applicable law.

3. Response to Valid Notice

Upon receipt of a valid DMCA notice, CNCTASPHR may review the reported material through its copyright review and administrative tools.

Depending on the circumstances, CNCTASPHR may:

  • Remove the allegedly infringing material;
  • Disable access to the allegedly infringing material;
  • Restrict visibility of the material while review is pending;
  • Notify the user who posted or uploaded the material;
  • Request additional information from the complainant or user;
  • Provide the user an opportunity to submit a counter-notification where applicable;
  • Take action against repeat infringers or accounts that misuse the Platform.

CNCTASPHR reserves the right to remove, restrict, or disable access to content that it reasonably believes infringes intellectual property rights, violates Platform policies, creates legal risk, or harms the integrity of the Platform, even absent a formal DMCA notice.

4. Counter-Notification Procedure

If you believe that material removed or disabled as a result of a DMCA notice was removed due to mistake or misidentification, you may submit a written counter-notification including:

  • Your physical or electronic signature;
  • Identification of the material removed or disabled and its prior location on the Platform;
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled due to mistake or misidentification;
  • Your name, mailing address, telephone number, and email address;
  • A statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, to the jurisdiction of a federal district court in Texas;
  • A statement that you will accept service of process from the person who submitted the original DMCA notice or that person’s agent.

Upon receipt of a valid counter-notification, CNCTASPHR may restore the material within 10–14 business days unless the original complainant notifies CNCTASPHR that they have filed a court action seeking an order to restrain the user from engaging in infringing activity related to the material.

CNCTASPHR may decline to restore material where restoration would violate law, Platform policies, user safety rules, or other legal obligations.

5. Repeat Infringer Policy

In accordance with 17 U.S.C. §512(i), CNCTASPHR maintains a policy providing for appropriate action, including termination where warranted, against users determined to be repeat infringers.

A repeat infringer may include any user who:

  • Has been subject to multiple valid DMCA notices;
  • Repeatedly uploads or shares content that infringes the rights of others;
  • Uses multiple accounts to continue infringing activity;
  • Attempts to re-upload material that was previously removed or disabled for copyright reasons;
  • Misuses CNCTASPHR’s audio, music, video, image, file, story, group, or profile features to distribute infringing material.

Actions may include warnings, removal of content, restriction of upload features, temporary suspension, permanent account termination, or prevention of re-registration.

Termination decisions are made at CNCTASPHR’s discretion based on the circumstances, applicable law, and Platform policies.

6. Misrepresentation

Pursuant to 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.

CNCTASPHR may reject notices or counter-notifications that appear incomplete, fraudulent, abusive, misleading, or submitted in bad faith.

7. DMCA Safe Harbor and Limitation of Liability

CNCTASPHR maintains procedures intended to support compliance with the DMCA, including receiving notices of claimed infringement, reviewing reported material, removing or disabling access to material when appropriate, and maintaining a repeat infringer policy.

Nothing in this Policy shall be construed as an admission of liability, a waiver of rights or defenses, or a guarantee that any particular claim, notice, counter-notification, or dispute will be resolved in a specific manner.

8. Modifications

Music, Audio, Video, and Uploaded Media

Users are responsible for ensuring that any music, audio, video, images, files, or other media they upload or share through CNCTASPHR is lawful and does not infringe the rights of others.

Uploading a song, beat, recording, podcast clip, video, image, document, or other media file to CNCTASPHR does not mean CNCTASPHR has verified ownership, cleared rights, licensed the work, or approved the content for commercial use.

CNCTASPHR may remove, restrict, disable access to, or review uploaded media when it receives a copyright complaint, identifies possible infringement, detects misuse, or determines that review is appropriate under Platform policies.

9. Modifications

CNCTASPHR reserves the right to modify this DMCA Policy at any time. Changes are effective upon posting.
